Looking into this difficulty with a more anthropological perspective can lead to a broader and simpler analysis framework. Violence is a central, although understated, aspect of artistic creation. Violence is also what legal rules basically and implicitly aim to counter. This indicates that social pacification is the possible first vocation of copyright law. Knowing about this vocation helps clarifying the gap between legal rules and their justifications.
