| Summary: | The effectiveness of on-site evidence
verification largely depends on the investigator’s
preparation for its production and the competent
choice of a course of action in each specific
situation. Taking into account minor’s age-related
psychological and physiological characteristics,
the issues of involving their legal representatives
in the investigative action under consideration
deserve increased attention. Purpose: to identify
organisational and tactical features of the on-site
minor’s evidence verification with the participation
of a legal representative. Methods: formal and
dialectical logic, description, analysis. Results: the
article highlights the importance of the motivational
component of the legal representative’s participation
in the on-site evidence verification. Based on the
analysis of empirical material, the article identifies
a set of factors under which on-site evidence may
be verified without the participation of a legal
representative. The article deals with the issues of
choosing a legal representative and his/her exclusion
from participation in the investigative action. The
characteristics of the preparatory and working
stages of the on-site minor’s evidence verification
with the participation of a legal representative are
noted. The article concludes on the ability of the legal representative to influence the course and result
of the investigative action and the importance of
taking this fact into account by the investigator. |
