| Summary: | This study aims to determine the application of material criminal law against criminal acts of physical violence in the scope of households that result in serious injuries in the case of Decision Number: 634 / Pid.Sus / 2018 / Pn.Mks.The research used to answer the problem above is a field research and data source that is primary data and secondary data.From the results of this study indicate that the application of material criminal law against criminal acts in the judge's decision in case No.634 / Pid.Sus / 2018 / Pn. Mks has complied with the applicable legislation in this matter regulated in Law Number 23 of 2004 concerning the elimination of domestic violence and the prosecutor uses a single indictment in this case.The implication ofthis research is that the judge in passing the verdict should pay attention to the things that are burdensome and the things that defend the defendant, so that the decision contains the value of justice for the accused and the victim. |
